ZEST SINGLES TERMS AND CONDITIONS

These Terms and Conditions apply to ZEST Singles membership and attendance at ZEST Singles and ZEST Speed Dating events.
Please read these Terms and Conditions before purchasing membership or booking an event. By purchasing membership, or booking or attending a ZEST event, you agree to these Terms and Conditions.
1. About ZEST Singles
ZEST Singles provides real-life social and dating events for single people aged 50 and over.
ZEST events are held at a variety of independent venues across Exeter, Devon and the surrounding area. The location of each event is stated on the individual event listing.
ZEST Singles is operated by Sarah Briggs as a sole trader.

In these Terms and Conditions, “ZEST”, “ZEST Singles”, “we”, “us” and “our” refer to ZEST Singles.
“Attendee”, “guest”, “member”, “you” and “your”, where appropriate, refer to a person using our services, purchasing membership or booking or attending an event.
2. Eligibility
ZEST Singles is for people aged 50 or over who are single and available to meet someone.
By becoming a member or booking an event, you confirm that:

you meet the eligibility requirements for the event you are booking;
-
the information you provide to ZEST, including your name, age and relationship status, is accurate;
-
you have the legal capacity to enter into an agreement with us; and
-
you will comply with these Terms and Conditions.
You must not attend ZEST if you have been convicted of an offence relating to serious violence, sexual offending or harassment, or are currently subject to a court order or restriction relating to such behaviour, where this would make your participation inappropriate or present a risk to others.
ZEST reserves the right to refuse or terminate membership, refuse a booking or refuse attendance at an event where reasonably necessary to protect the safety, wellbeing or respectful atmosphere of ZEST and its attendees.
3. If You Start Seeing Someone
We recognise that meeting someone does not necessarily mean that you are immediately in an established relationship.
If you begin seeing someone, you may continue attending ZEST events for up to three months while you get to know each other.
If during that period you consider yourself to be in an established relationship, you should stop attending ZEST Singles events.
The three-month period is intended to provide reasonable time for a new relationship to develop and is not intended to allow people who are already in an established relationship to continue attending singles events.
4. ZEST Membership
ZEST Membership costs £29 per month, unless a different price is clearly stated before you subscribe.
Membership begins on the date you subscribe and runs monthly from that date.
Membership is a rolling monthly subscription with no minimum term and may be cancelled at any time.
After any applicable statutory cancellation period has ended, cancellation will normally take effect at the end of the membership period you have already paid for. No further monthly membership payment will then be taken.
Except where you have a statutory right to a refund, membership payments already made are non-refundable and are not apportioned or partially refunded for an unused part of a membership month.
Membership benefits apply only while your membership remains active.
Membership benefits apply to future bookings and cannot be applied retrospectively to event tickets purchased before joining.
14-day cancellation right
If you purchase ZEST Membership online or otherwise at a distance, you have the right to cancel your membership within 14 days of entering into the membership contract, without giving a reason.
ZEST Membership and its benefits can begin immediately. If you ask for your membership to begin during the 14-day cancellation period, you expressly request that ZEST begins providing the membership service before that period has ended.
If you exercise your statutory right to cancel after your membership service has begun at your request, ZEST may deduct from any refund an amount proportionate to the membership services already provided up to the time you tell us that you wish to cancel, as permitted by law.
Any refund due will be made in accordance with your statutory rights.
Nothing in these Terms and Conditions limits your statutory cancellation or refund rights.
5. Events Booked Using Membership
Active members may attend eligible ZEST Singles events without paying the standard non-member attendance fee, subject to availability and the terms of the individual event.
ZEST Speed Dating is not included within ZEST Membership.
You may book eligible ZEST Singles events in advance using your membership benefit. However, your membership must still be active on the date of the event.
If your membership is no longer active on the date of an event booked using the member rate, the normal non-member attendance fee for that event will become payable before you attend.
6. Membership Codes and Booking for Other People
Any membership promotional code or other member booking benefit supplied to you is personal to you.
You must not use your membership or promotional code to obtain a member ticket for another person unless that person is also an active ZEST member and entitled to the member rate.
Membership cannot be transferred, shared or used by another person.
ZEST may check membership status against event bookings to confirm that attendees using member tickets are active members on the date of the event.
7. Pay Per Event
You do not have to be a ZEST member to attend most ZEST events.
Where Pay Per Event tickets are offered, non-members may purchase an individual ticket at the price shown on the event listing.
Membership and event prices may change from time to time. The applicable price will be clearly stated before you subscribe or book.
8. ZEST Singles Event Cancellations
Cancellation terms will be shown on the individual event listing.
Unless otherwise stated on the event listing, if you cancel more than 7 days before a ZEST Singles event, you may choose:
-
a full refund of the ticket price, less any non-refundable Eventbrite fees; or
-
a transfer to another available ZEST Singles event.
If you cancel within 7 days of the event, your ticket is non-refundable and non-transferable, except where you have a statutory right to a refund.
Any event-specific cancellation terms clearly stated on the event listing before booking will apply to that booking.
9. ZEST Speed Dating Cancellations
ZEST Speed Dating has a different cancellation policy because places are limited and the event relies upon achieving an appropriate balance of participants.
If you cancel more than 30 days before a ZEST Speed Dating event, you may choose:
-
a full refund of the ticket price, less any non-refundable Eventbrite fees; or
-
a transfer to another available ZEST Speed Dating event.
If you cancel between 14 and 30 days before the event, your ticket is non-refundable. However, you may request one transfer to another available ZEST Speed Dating event.
If you cancel less than 14 days before the event, your ticket is non-refundable and non-transferable, except where you have a statutory right to a refund.
Only one transfer is permitted. Once a booking has been transferred, it cannot be transferred again or refunded.
Bookings and credits cannot be transferred between ZEST Speed Dating and ZEST Singles events.
10. If ZEST Cancels an Event
If ZEST cancels an event, you will be offered either:
-
a full refund of the amount you paid for the ticket, including any Eventbrite booking fees you paid; or
-
the opportunity to transfer your booking to another appropriate available ZEST event.
ZEST will make reasonable efforts to notify attendees of cancellations using the contact information supplied when booking.
ZEST is not responsible for additional costs incurred by attendees in connection with attending an event, such as travel, accommodation or other personal expenses, except where the law requires otherwise.
11. Event Bookings
Purchasing or reserving a ticket gives you a place at the specific event booked, subject to these Terms and Conditions and any additional conditions clearly stated on the event listing.
Tickets cannot be transferred to another person without ZEST's agreement.
Places are subject to availability.
You must provide accurate contact information when booking, including a current email address and, where requested, mobile telephone number.
You are responsible for checking your email before attending an event for final information, changes or other important communications from ZEST.
12. What Your Event Ticket Includes
Unless specifically stated otherwise on the individual event listing, your ZEST event ticket covers attendance at the event only.
Food, drinks, activity charges, venue costs and other purchases are paid separately by the attendee unless the event listing expressly states that they are included within the ticket price.
13. ZEST Speed Dating – Age Requirements
Each ZEST Speed Dating event will state the age range for that particular event.
You must be within the advertised age range on the date of the event.
ZEST relies upon attendees providing accurate information about their age and cannot independently guarantee that information provided by every attendee is correct.
ZEST may refuse or cancel a booking where an attendee does not meet the advertised age requirements.
14. ZEST Speed Dating – Event Format and Attendance
ZEST Speed Dating provides participants with a structured opportunity to meet other single people.
ZEST aims to create an appropriate balance of participants at Speed Dating events. However, because these are live events and cancellations and non-attendance can occur, ZEST cannot guarantee:
-
a particular number of attendees;
-
an exact balance between men and women;
-
the specific ages of other participants beyond requiring attendees to meet the advertised age criteria;
-
that you will wish to match with another participant;
-
that another participant will wish to match with you; or
-
any particular dating or relationship outcome.
15. ZEST Speed Dating – Matches
Following a ZEST Speed Dating event held on a Wednesday evening, participants have until 12 noon on the following Saturday to submit their choices to ZEST.
Choices received after the stated deadline will not normally be processed.
Where two participants select each other and there is a mutual match, ZEST will introduce them to each other by email.
For mutual matches, ZEST will share the participants' email addresses only. Mobile telephone numbers will not be provided by ZEST.
Speed Dating choices are confidential.
ZEST will not disclose which participants selected or expressed an interest in another participant unless there is a mutual match.
ZEST cannot guarantee that a participant will receive a mutual match, that a matched participant will subsequently make contact, or that any contact will result in a date or relationship.
Once ZEST has made a mutual introduction, any subsequent communication or meeting between participants is their own responsibility.
16. Behaviour and Respect for Others
ZEST events are intended to provide a welcoming, comfortable and respectful environment.
Attendees are expected to behave appropriately towards other attendees, ZEST hosts and representatives, venue staff and other people using the venue.
Harassment, threatening or intimidating behaviour, aggression, persistent unwanted contact, serious disruption, discrimination or other behaviour that adversely affects the safety or reasonable comfort of others will not be accepted.
Where reasonably necessary, ZEST reserves the right to:
-
refuse a booking;
-
refuse admission to an event;
-
ask an attendee to leave an event;
-
decline future bookings; or
-
terminate membership.
This may apply where ZEST reasonably considers that an individual's behaviour is inconsistent with the safety, wellbeing or respectful atmosphere of ZEST events.
Where an attendee is required to leave, refused attendance or has membership terminated because of serious misconduct or a material breach of these Terms and Conditions, any entitlement to a refund will be determined in accordance with applicable consumer law.
17. Accessibility and Inclusion
ZEST endeavours to make its events welcoming and inclusive.
However, due to the nature, format, location or physical requirements of some events, not every event may be suitable or safe for every individual.
Where appropriate, ZEST will consider reasonable adjustments to enable participation.
Adjustments may not always be possible where they would fundamentally alter the nature or format of the event being offered or affect its safe and effective operation.
If you have accessibility requirements or are unsure whether a particular event is suitable for you, please contact ZEST before booking so that we can discuss this with you.
18. Personal Safety
ZEST provides opportunities for single people to meet but does not carry out comprehensive background or identity checks on attendees.
You are responsible for making your own decisions about people you meet through ZEST.
If you subsequently arrange to meet another attendee privately, you do so independently of ZEST and should take reasonable precautions for your personal safety.
If you experience or become aware of inappropriate, threatening or concerning behaviour connected with a ZEST event, please notify ZEST as soon as reasonably possible.
Nothing in these Terms prevents you from contacting the police or another appropriate authority where necessary.
19. Transport
Attendees are responsible for arranging their own transport to and from ZEST events.
ZEST does not provide transport or lifts to attendees.
20. Photography and Video
ZEST respects the privacy of its attendees and does not routinely photograph events.
From time to time, photographs or video may be taken at an event for ZEST marketing, publicity or social media.
Where photography or filming is planned, attendees will be made aware and anyone who does not wish to be photographed or filmed may opt out.
Further information about how ZEST uses personal information, including photographs and video where applicable, is contained in the ZEST Privacy Policy.
21. Venues and Third-Party Activities
Many ZEST events take place at independent venues or involve services supplied by third parties.
Attendees must comply with any reasonable rules, safety requirements or instructions imposed by the venue or third-party provider.
ZEST is not responsible for the acts or omissions of independent venues or third-party providers except to the extent that responsibility cannot lawfully be excluded.
Where an event includes an activity provided by a third party, additional terms or requirements imposed by that provider may apply and will be communicated where appropriate.
22. Event Changes
ZEST will use reasonable efforts to hold events on the date, at the time and at the venue advertised.
Occasionally it may be necessary to change an event's venue, timing, format or other arrangements.
Where there is a significant change, ZEST will make reasonable efforts to notify booked attendees as soon as practicable.
If a change materially alters the event you booked, any entitlement to cancel or obtain a refund will be considered in accordance with your statutory rights.
Minor changes that do not materially affect the event will not normally give rise to a right to a refund.
23. Personal Information and Data Protection
ZEST uses personal information to administer membership, event bookings, communications and the operation of its services.
ZEST currently uses third-party services including Eventbrite for event registration and management and HubSpot for customer relationship management and communications.
Personal information will be processed in accordance with ZEST's Privacy Policy and applicable UK data protection law.
ZEST Singles is registered with the Information Commissioner's Office under registration number C1193179.
Please refer to the ZEST Privacy Policy for further information about how personal information is collected, used, stored and protected and about your data protection rights.
24. Communications
ZEST may contact you where reasonably necessary to administer your membership, booking or another service you have requested.
This may include communications concerning:
-
booking confirmations;
-
event information;
-
venue or timing changes;
-
cancellations;
-
Speed Dating match administration;
-
membership administration; and
-
other information directly relevant to a service you have requested.
Marketing communications are dealt with separately in accordance with applicable law and the ZEST Privacy Policy.
25. Website and Third-Party Platforms
ZEST may use third-party websites and platforms, including Eventbrite, HubSpot and payment providers, in providing its services.
Those services may have their own terms and privacy policies.
The ZEST website may also contain links to third-party websites. ZEST does not control those websites and is not responsible for their content, availability or services.
26. Intellectual Property
The content of the ZEST website and ZEST-created materials, including text, branding, graphics and other original content, belongs to ZEST or is used by ZEST with appropriate permission.
You must not reproduce, copy, publish, distribute or commercially exploit ZEST content without prior permission, except where permitted by law.
27. Liability and Consumer Rights
ZEST will provide its services with reasonable care and skill.
Nothing in these Terms and Conditions excludes or restricts any rights or remedies that cannot lawfully be excluded or restricted.
In particular, nothing excludes or limits ZEST's liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded.
Subject to those rights, ZEST is not responsible for losses arising from circumstances outside its reasonable control or for losses that were not reasonably foreseeable.
ZEST is not responsible for the compatibility, statements or subsequent actions of individual attendees, although ZEST may take reasonable action where inappropriate behaviour is brought to its attention.
ZEST does not guarantee that attendance at an event will result in friendship, a date, a mutual match or a relationship.
Nothing in these Terms and Conditions affects your statutory consumer rights.
28. Alcohol and Personal Responsibility
Where alcohol is available at a venue, attendees are responsible for their own consumption and behaviour.
Venue rules concerning alcohol must be followed.
Nothing in this section excludes or limits liability where it would be unlawful to do so.
29. Ending Membership
You may cancel your rolling monthly membership at any time.
After any applicable statutory cancellation period has ended, cancellation will normally prevent the next membership renewal and your membership will remain active until the end of the period already paid for.
Except where you have a statutory right to a refund, cancellation does not generate a refund for a membership period that has already begun.
Any future event booked using the member rate that takes place after your membership has ended will become subject to the normal non-member attendance fee.
ZEST may terminate membership where reasonably necessary because of non-payment, a material breach of these Terms and Conditions, serious inappropriate behaviour, safety concerns or other circumstances that make continued participation inappropriate.
Any refund due following termination by ZEST will be determined fairly having regard to the circumstances and your statutory rights.
30. Changes to These Terms and Conditions
ZEST may update these Terms and Conditions from time to time to reflect changes to its events, membership, services, business practices or legal requirements.
Changes will not remove or reduce statutory rights that you already have.
Where a change materially affects an existing membership or booking, ZEST will take reasonable steps to notify affected customers where appropriate.
The Terms and Conditions applying to an event booking will normally be those in force when the booking is made, together with any specific terms stated on the relevant event listing.
31. General
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue to apply.
A failure by ZEST to enforce a provision on one occasion does not prevent ZEST from enforcing that provision in the future.
These Terms and Conditions are governed by the laws of England and Wales.
If you live elsewhere in the UK, you retain any rights you have under applicable law concerning where legal proceedings may be brought.
Nothing in these Terms and Conditions affects any rights you have under applicable consumer law.
